Every order constitutes acceptance by the buyer of our terms and conditions. These terms and conditions form an integral part of the agreement as described below. When an order is placed, the user declares that he or she is eighteen years of age or older. Content

By ‘content’ we mean all products, texts, images, descriptions
and other data mentioned on this website. The selection, composition and arrangement thereof are also included. We cannot guarantee that the content is free of mistakes, omissions or typographical errors, or that the information is always
up to date.

We have the right to adjust, change or remove the content at any time, without prior notice. If a material change is made to a product during the ordering process, the buyer will be notified immediately. The content is not binding and is intended for information purposes only.

The content of this website, images, logos, drawings, photos, data, product names, texts, etc. are protected by worldwide copyright and other property rights and treaty provisions.

Quotations, acceptance of the order and prices

All our quotations are without obligation. We are only bound by an order after we have confirmed it in writing or after we have started performing it. The information about the products and the pricing, as well as the detailed order information, are drawn up and communicated subject to change and correction.

All prices of products and services on this website are stated in Euro and include VAT (6% or 21%). Transport costs, taxes and other levies are not included, unless stated otherwise or explicitly agreed in writing.

Shipping costs are added after an order has been placed, and payment can be made using the options indicated during the ordering process. The date on which the amount due is credited to the bank account of BAM Coffee is deemed to be the date of payment.

All offers from Bam.cofffee are free of obligations. Bam.cofffee may change prices at any time without prior notice. Invoicing is based on the amount stated on the order confirmation. If the prices of products and services were to increase between the date of the order and the execution of the order, the buyer has the right to cancel the order or the agreement within 14 days after Bam.cofffee has announced the price increase.

Delivery

Products are only delivered to the countries for which the website permits delivery. Products will, as far as possible, be delivered within the time frame communicated in the individual order confirmation.

Incorrectly provided delivery addresses are the responsibility of the buyer
and may give rise to additional costs. Unless agreed otherwise, our prices do not include the transport and delivery of the goods to the buyer. The costs of transport and delivery are stated separately.

The stated delivery times are not binding, but are given purely as an indication. No delay in delivery can give rise to cancellation of the purchase or to payment of damages in favour of the buyer, except in the case of intentional delay. We have the right to make partial deliveries. In the event of non-delivery of the goods, any sums paid by the buyer will be refunded without interest or other compensation.

The buyer is responsible for all additional taxes and levies. Bam.cofffee cannot be held responsible for any charges levied by a third party.

Force majeure

We are not liable for a delay in performance
or for non-performance of our obligations due to events beyond our normal control, including production interruptions, difficulties in supply or shortages of raw materials, labour, energy or transport, or delays in transport, strikes, lock-outs, work stoppages or other collective labour disputes affecting either ourselves or our suppliers,
and this even if such events are foreseeable.

Warranty

Our warranty is limited to the warranty for hidden defects and
the warranty in the event of a consumer sale, both provided for in the Civil Code. We are only liable for damage resulting from intent or gross negligence.
We are not liable for general or special indirect damage,
of whatever nature, suffered by the Buyer.

In order to be admissible, complaints must reach us: (a) in the event of a complaint due to non-conforming delivery, eight (8) days after delivery, and (b) in the event of hidden defects, eight (8) days after discovery of the defect or after the moment at which such discovery could reasonably have taken place. Acceptance of the goods by the buyer covers any possible defect or non-conformity that could be established at that time.

Right of withdrawal

In the context of distance selling to consumers falling within
the scope of the Act of 14 July 1991, the consumer has the right to notify the seller that he waives the purchase, without payment of a penalty and without stating a reason, within 7 working days from the day following delivery. If the consumer invokes this option,
he must return the goods in their original condition and packaging, at his own risk and expense, to Bam.cofffee, Venusbergstraat 53, Paal (Belgium). Products can only be returned after consent from Bam.cofffee and must be accompanied by the invoice. The product will then be replaced or refunded
(see 'returns'), depending on the availability of the product and the wish of
the customer.

Personal data

When products or services are purchased, the buyer explicitly agrees that his/her personal data may be used for administrative purposes, such as creating and maintaining a customer database, keeping track of orders, shipments and invoices, and checking creditworthiness. Personal data will only be processed for promotional purposes, personalised advertising and/or other (re)marketing purposes.

Bam.cofffee will never pass on this personal information to third parties, unless this is explicitly requested by judicial authorities or when
it is legally required to do so. The buyer has the right at any time to modify or view his/her personal information. The buyer also has the right to object free of charge to the processing of his personal data for direct marketing initiatives. For more information on this, the buyer can contact the Privacy Commission in Brussels.

Evidence

Within the framework of their relations, the parties concerned accept

lectronic evidence.

Severability

If an article of these terms is declared null and void, this nullity will not affect the validity of the remaining articles.

Bam.coffee is entitled to amend the content of these Terms and Conditions. Changes are announced via the website.

Applicable law

All agreements concluded with the seller are governed by Belgian law. The Belgian courts have exclusive jurisdiction.
